The case will decide who has the right to enforce laws, and what rights the states have when the federal government fails to act:

At stake is Arizona’s goal of granting state and local police the power to check the immigration status of persons they encounter during their duties, such as traffic stops. Administration lawyers argue the state statutes infringe on what is federal responsibility to police the borders and set immigration policy.

Radio show host, and APM leader Tony Katz, has been discussing, and advocating, for SB 1070 since its passage. Specifically, he has offered free radio advertising for Arizona businesses that were affected by the boycott of Arizona, and led a group of people in the Buy Arizona! Weekend, which brought tourism dollars to the state.

Justice Kagan’s recusal on this issue brings new questions as to whether or not she will recuse herself when the court hears Obamacare, and whether government can force the people into contract:

Justice Kagan has come under fire for not recusing herself from the decision to hear challenges to the new health care law.

She was Mr. Obama’s solicitor general from March 2009 up through May 2010, though she stopped taking part in cases in March 2010 so she would preserve her ability to hear them as a justice.

As Tony wrote on Townhall.com, Kagan’s need to recuse is not debatable:

What does it say if Kagan does not recuse herself? If politics is placed above the law – and its rightful inspection and scrutiny – then of what value is the law? If ideology trumps morality, then of what value is the court itself, or the law, or the Republic?

It is good that Justice Kagan sees that her former job as Solicitor General has a serious impact on the cases she hears, like SB 1070.  One hopes that her good sense continues, and she recuses herself from Obamacare as well.
